On January 18, 1968, in the early morning hours, the defendant was placed under arrest on a drunk and disorderly charge. The resisting arrest charge arises from an incident occurring at the police station where the defendant was transported by patrol wagon. Facts material to the issues raised will be set forth in the opinion. On January 23, 1968, a complaint was filed and warrant issued, charging the defendant with resisting an officer in violation of sec. 946.41 (1), Stats. Following the arrest and appearance of defendant in county court (where he entered a plea of not guilty and a demand for jury trial), the case was transferred to the circuit court. On February 15, 1968, jury trial was waived by defendant and trial was had to the court. Defendant was found guilty and fined $100 and costs. From this judgment defendant appeals. Subsequently, defendant moved for a new trial on the basis of newly discovered evidence and insufficiency of evidence. On January 29, 1969, the motion for a new trial was denied.
