Description

These cases involve the conviction of the two defendants, Karl Patrick Christel and William Richard Suzor, on August 2, 1972, for possession with intent to sell a dangerous drug, hashish, a form of marijuana, contrary to sec. 161.30 (12) (d), Stats. 1969. Judgments of conviction were entered following jury verdicts against Christel and Suzor. Sentences were withheld and the defendants were placed on probation for two years. Christel and Suzor appeal from the judgments of conviction and from an order denying defendants' motion to suppress certain evidence obtained in what they claim was an illegal search. In the regular course of business a package arrived at the Madison office of Railway Express Agency (REA); the package was addressed to Catherine Baldwin of 1427 Williamson Street, Madison, Wisconsin. The package listed Ann Triggs of Berkeley, California, as the sender. The package was shipped on February 9, 1972, and arrived the following day in Madison. Some time prior thereto, the Madison Metropolitan Narcotics Squad had learned that a large sum of money, approximately $4,000, had been sent by suspected drug traffickers from Madison to Berkeley, California. The Metro Squad then alerted the local personnel of REA to watch for packages coming from Berkeley. According to the information possessed by the Metro Squad, the money had been sent to Steve Dietz.
